On October 1st, 2017, a recently enacted New York State law will take effect, permitting eligible persons, who have non-violent felony and/or misdemeanor criminal convictions, to apply to their sentencing court for the public sealing of their records.

This long-awaited statute (New York Criminal Procedure Law Section 160.59), which is one of the most expansive sealing laws in the nation, will provide relief to thousands of individuals, whose prior convictions have negatively affected their reputations, employment opportunities, and good standing in the community.

 

To be deemed eligible, the conviction must have occurred 10 years prior to the sealing application, the applicant must not have been convicted of a crime since the date of their conviction and have led a productive, law-abiding life.

Once eligibility has been established, a formal legal motion, containing a detailed history of the conviction and the productivity of the individual, must be prepared and submitted to the Court, which sentenced the applicant.
